RETENTION OF SERVICES AS A MEDIATOR

 

The hourly rate is $500.00 for two party mediations, $550.00 for three party mediations, and $600.00 for four party mediations. For any mediation in excess of four parties, the rate will be $100.00 per party per hour. Rate is inclusive of travel time, which is equally split among the parties.

CANCELLATION POLICY

 

A cancellation fee of four (4) hours will be charged for any mediation cancelled less than three (3) business days prior to the scheduled mediation, excluding weekends and holidays. Should your office disagree with this fee arrangement, please contact me within five days of this letter.

Mr. Nicholas is Board Certified in both Civil Trial Law and in Business Litigation. He has a Real Estate license through the State of Florida – Department of Business and Professional Regulation, as well as a Life, Health and Variable Annuity Insurance License from the State of Florida – Department of Financial Services. He is admitted to the Florida, Illinois, Pennsylvania and Colorado Bars and is approved to appear before the United States Supreme Court.

Mr. Nicholas is also a Certified Federal and State Arbitrator, a Certified Circuit Civil, Appellate and Residential Mortgage Foreclosure Mediator, as well as a Family Law Mediator.

He graduated in the very first class in Florida that certified mediators and he has been mediating cases for the past thirty-one years. During the last twelve years, his primary practice has been mediation.

OVERCOMING CHALLENGES BY CREATING OPPORTUNITIES

With more than forty years of trial practice experience, Mr. Nicholas has a solid background in all areas of civil litigation including personal injury (both plaintiff and defense), first and third party insurance claims, owner-contractor construction disputes, employment law and general civil corporate matters. As a former insurance claims adjuster, as well as an independent adjuster prior to law school, Mr. Nicholas have had considerable experience in bodily injury and wrongful death claims handling. His current practice consists of both plaintiff and defense litigation.

Other experience includes business and construction litigation; insurance and property damage claims; as well as mediating hundreds of disputes between unit owners, developers, contractors, and condominium associations (pursuant to F.S. 718) and homeowners associations (pursuant to F.S. 720). Of these, many of these cases have involved Windstorm and Flood Damage claims, as well as mold remediation and general repairs secondary to the Hurricanes. Most recently, mediation cases have included Cast Iron Pipe Plumbing System failures. Mr. Nicholas’s experience also includes mediating eminent domain issues (pursuant to F.S. 73) as well as Probate, Guardianship and other Estate matters.
